These Terms govern access to the public website presented under the bitgo brand. They apply only to public website use and do not replace any binding agreement for a product, integration or service.

This document covers the public website only. Binding agreements, provider notices and mandatory local law may apply separately and control where they conflict. bitgo is the public-facing brand; no legal, licensing, regulatory, asset-safeguarding or financial-service status should be inferred from this website.

Operator and scope

These Terms apply to the public pages and informational materials made available at https://bitgowallet.com under the bitgo brand. References to we, us or our mean the website operator identified in the applicable corporate notice. If that identity is not displayed for your interaction, request it from legal@bitgowallet.com before sending a formal notice.

These Terms do not govern a client account, authenticated portal, API, transaction, wallet, integration or separately contracted service. Those activities are governed by the binding agreement and disclosures of the entity that actually provides them.

Acceptance and authority

By using the website, you acknowledge these Terms. If you use it for an organization, you represent that you have authority to act for that organization and that it will be responsible for your use. If you do not agree, do not continue to use the website.

Nothing in these Terms limits rights that cannot lawfully be waived, including mandatory consumer or data-protection rights that apply in your country.

Separate service agreements

A reference to a product or capability is descriptive only. Access to any service requires separate onboarding, due diligence, approval and binding documentation with the relevant provider. If these Terms conflict with an executed service agreement, that agreement controls for the applicable service.

Contracting entities, provider roles, safeguards, fees and client protections can differ by product and location. You should identify the contracting entity, verify any claimed authorization directly with the relevant authority and read the applicable terms before using a service.

This public website does not create an asset-safeguarding, fiduciary, advisory, brokerage, banking, payment or other professional relationship.

Eligibility and compliance

The website is intended for adults and professional or business audiences. You must be at least 18, have legal capacity and use the site only where lawful.

You may not use the website to evade sanctions, export controls, anti-money-laundering rules or other applicable restrictions, or on behalf of a prohibited person. Access from a location does not mean a product is lawfully offered there.

Digital asset and technology risks

Digital assets and related infrastructure involve substantial risks and may not be appropriate for every person or organization. You are responsible for assessing those risks before taking any action.

  • Market prices and liquidity can change rapidly, and an asset can lose some or all of its value.
  • Blockchain transfers can be irreversible, delayed, rejected or sent to an incorrect or incompatible address.
  • Protocols, smart contracts, bridges, validators, oracles and third-party software may fail, be exploited or change.
  • Forks, airdrops, network congestion, governance decisions and protocol upgrades can affect rights and availability.
  • Private-key loss, credential compromise, social engineering and operational error can cause permanent loss.
  • Tax, sanctions, accounting and regulatory treatment can change and differ across jurisdictions.

No website security statement eliminates the inherent risks of digital assets, networks or third-party protocols.

Accuracy and reliance

We seek to present useful information but do not promise that every page is complete, current or error-free. Market, regulatory, product and third-party information can become outdated without notice.

You should verify material information from primary documentation before relying on it. We may correct errors, update content or remove materials at any time.

Security and external sign-in

Links to sign-in or product environments may lead to a separate service with its own security requirements and terms. You are responsible for checking the destination, protecting your device and credentials, and using only verified channels.

We will never ask you through this public contact experience to disclose a private key, recovery phrase, password or authentication code. Suspected phishing, impersonation or vulnerability issues should be reported to security@bitgowallet.com.

Intellectual property and licence

The website, code, design, text, graphics, marks, logos, documentation and compilations are protected by intellectual-property and unfair-competition laws. Subject to these Terms, we grant you a limited, revocable, non-exclusive, non-transferable licence to access the public website for lawful internal use.

No ownership right is transferred. You may not reproduce, modify, distribute, sell, sublicense, create derivative works from or commercially exploit protected material without written permission or an applicable legal exception.

Trademarks and attribution

Names, logos and product marks displayed on the site belong to their respective owners. Use of a mark does not imply endorsement or permission. You may not use our branding in a way that suggests affiliation, sponsorship, approval or an official service when none exists.

Third-party names, logos, domains and contact addresses may be used only with the relevant authorization and must accurately identify the website operator.

Displayed branding and contact destinations must be authorized, accurate and controlled by the website operator.

The website may link to blockchain explorers, regulators, social networks, publications or other third-party resources. Links are provided for convenience and do not make us responsible for external availability, accuracy, security, privacy or conduct.

Your use of an external resource is governed by that provider's terms. Review the destination before submitting information or connecting a wallet or account.

Feedback and communications

If you voluntarily provide non-confidential feedback about the website, you grant us a worldwide, perpetual, irrevocable, royalty-free right to use and adapt that feedback without obligation to you. This does not transfer ownership of personal data or material you clearly identify as confidential.

Electronic communications can be delayed, intercepted or misdirected. An email does not constitute formal legal notice unless these Terms, an applicable agreement or mandatory law expressly permits that method.

Confidential information and prohibited secrets

Do not send private keys, seed or recovery phrases, passwords, one-time codes, API secrets, unnecessary identity documents, client personal data or confidential transaction instructions through the public contact page.

The contact form prepares a draft in your own email application and does not upload the fields to this website. Information is received by us only if you choose to send that email. Use an approved secure support channel for sensitive account matters.

Privacy and cookies

The Privacy Policy explains how personal data associated with website use and communications is handled. The Cookie Policy describes local device storage and optional controls. Those policies form part of the website transparency framework but do not reduce rights under applicable law.

Website disclaimers

To the extent permitted by law, the public website is provided as is and as available. We disclaim implied warranties of merchantability, fitness for a particular purpose, title and non-infringement, and do not warrant uninterrupted access, perfect security or that content will meet your requirements.

These exclusions do not apply where they are prohibited, nor do they limit an express commitment in a binding service agreement.

Limitation of liability

To the maximum extent permitted by applicable law, bitgo and its affiliates will not be liable under these website Terms for indirect, incidental, special, exemplary, punitive or consequential loss, or loss of profits, revenue, opportunity, goodwill or data, arising from reliance on the public website.

Nothing excludes or limits liability that cannot lawfully be excluded, including liability for fraud, fraudulent misrepresentation, wilful misconduct, gross negligence where applicable, death or personal injury caused by negligence, or mandatory consumer rights. Liability arising from a product service is governed by its separate agreement.

Enforcement, suspension and changes

We may investigate misuse and restrict or suspend access where reasonably necessary to protect the website, users or legal rights. We may cooperate with lawful authority requests consistent with applicable law.

We may revise these Terms to reflect legal, security, operational or website changes. The effective date identifies the current version. Material changes apply prospectively, and any additional notice or consent required by law will be provided. Provisions that by their nature should survive termination remain effective.

Governing law, notices and miscellaneous

The governing law and competent forum are those validly identified in a binding agreement or in the website operator's applicable corporate notice, subject always to mandatory conflict-of-law, consumer-protection and access-to-court rules. Where no valid choice applies, governing law and jurisdiction are determined under the rules that apply to the parties and dispute; no jurisdiction is selected by this website text alone.

Before sending a formal notice, request and verify the operator's current legal name, registered-office details and permitted delivery method, unless a binding agreement already specifies a different process.

If a provision is unenforceable, it will be limited to the minimum extent necessary and the remaining provisions continue. A failure to enforce is not a waiver. Headings aid reading only. These Terms and incorporated policies are the entire agreement about public website access, but do not replace a product agreement.
